“Hi, my name is Andrew Kinney; I’m an attorney at Hoglund Law Offices. I practice Social Security disability law, and I also represent people with Supplemental Security income claims, otherwise known as SSI.

Today I wanted to talk about representative payees. Now most of the other videos you might see and other material on Hoglundlaw.com, most is geared toward people trying to get on benefits. This video is about what do you do when you get on benefits, and how is it paid out.

If you are at a hearing, for example, and there are some issues at to whether you can handle money, and the judge knows that you will be approved, then the judge also will include information internally as to whether you should receive the money directly or through a family member. That is what a representative payee is. The representative payee receives the money for someone else who is disabled.

An example of a representative payee situation is if someone unfortunately has mental retardation and as a result can’t handle his or her own money. So there will be a family member, friend, or an entity that will be appointed to receive the money for them. Now, it is the money of the disabled person, that is absolutely true, but the idea is that we want to make sure the money is handled properly and in the best interest of the disabled person.

Keep in mind if there is a representative payee in your case, the idea is that you are approved and that you do have your money, but there is also someone that is overseeing how that money is spent, especially back-pay that you would see perhaps in one lump sum.
